3. SMS / Text Messaging Program

Fairways Golf operates an SMS text messaging program for transactional and account-related communications, including one-time passcodes, booking and registration confirmations, and facility access links.

• Consent is required. You will only receive SMS messages from us if you have provided your mobile number and expressly opted in (for example, by checking an opt-in box during account registration or booking).
• Message frequency. Message frequency varies based on your account activity and bookings.
• Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan.
• Opt out. You can opt out at any time by replying STOP to any message. You will receive a single confirmation message and will not receive further SMS messages from our program.
• Help. Reply HELP to any message, or contact us at support@fairwaysgolftx.com, for assistance.
• Carriers. Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

Mobile Information Sharing — No Sale, No Third-Party Marketing

No mobile information, including phone numbers, SMS opt-in status, or consent records, will be shared with or sold to third parties or affiliates for marketing or promotional purposes at any time. Information collected as part of the SMS program is used only to operate the messaging program itself and to deliver the transactional messages you have requested.

Mobile information may be shared only with subprocessors that directly support message delivery (for example, our SMS gateway provider, Twilio), and those providers are contractually prohibited from using your information for their own marketing purposes.

4. We Do Not Sell Your Information

Fairways Golf will never sell, rent, or trade your personal information — including your mobile phone number and SMS consent data — to third parties for their marketing purposes. Period.

5. Payment Information

All payment processing is handled by secure third-party payment processors. We do not store, retain, or have access to your full credit card numbers, debit card numbers, or bank account details on our systems. Payment data is transmitted directly to our processor using industry-standard encryption.

6. Sharing with Service Providers

We may share limited personal information with trusted vendors and service providers who assist us in operating our business — such as booking platforms, email marketing services, SMS messaging providers, payment processors, and IT providers. These third parties are contractually obligated to use your information only for the specific services they provide to us and to protect it in accordance with this policy. As stated in Section 3, mobile opt-in information is never shared for marketing or promotional purposes.

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction. While no method of transmission over the internet is completely secure, we take commercially reasonable steps to protect your data.

Under the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024, Texas residents have the right to:

• Confirm whether we are processing your personal data
• Access your personal data
• Correct inaccuracies in your personal data

9. Photography & Use of Likeness

Fairways Golf may photograph or video record events, activities, and general facility operations for use in marketing, social media, website content, and promotional materials. By entering our facility, you acknowledge that your likeness may be captured and used for these business purposes.

• Photographs and video may be used across our website, social media accounts, print materials, and advertising
• If you do not wish to have your likeness used, please notify a staff member upon arrival or contact us in writing
• We will make reasonable efforts to honor opt-out requests, though we cannot guarantee removal from all materials already in circulation
• We will never sell photographs or video of customers to unaffiliated third parties

10. Security Surveillance & Unmanned Facility Operations

For the safety and security of our customers, staff, and property, Fairways Golf operates security surveillance systems throughout the facility. Additionally, portions of our operating hours may involve unmanned or self-service access where staff are not physically present on-site.

• Video surveillance cameras are in operation in common areas, hallways, entry/exit points, and simulator bay areas at all times
• Surveillance footage is used solely for security, safety, incident investigation, and loss prevention purposes
• During unmanned operating hours, surveillance systems remain active and may be monitored remotely
• Access during unmanned hours is controlled via electronic entry systems and may be logged for security purposes
• Surveillance footage is retained for a limited period and is not shared with third parties except as required by law or in connection with a security incident
• Restrooms and private changing areas are never subject to video surveillance

11. Cookies & Tracking

Our website may use cookies and similar technologies to improve your browsing experience and analyze site traffic. You may disable cookies through your browser settings at any time, though some features of the site may not function as intended.

12. Children's Privacy
