WAIVER AND RELEASE OF LIABILITY

Fairways Golf Texas LLC

By signing this document, I acknowledge and agree to the following:

1. Assumption of Risk. I understand that using golf simulator bays, equipment, and related facilities involves inherent risks including but not limited to: physical injury from swinging golf clubs, repetitive motion strain, trips and falls, and equipment malfunction. I voluntarily assume all such risks.
2. Release of Liability. I, on behalf of myself, my heirs, and assigns, hereby release, waive, and discharge Fairways Golf Texas LLC, its owners, officers, employees, and agents from any and all claims, liabilities, damages, or causes of action arising from my use of the facilities.
3. Facility Rules. I agree to follow all posted rules, staff instructions, and safety guidelines while on the premises. I understand that failure to comply may result in removal from the facility without refund.
4. Guest Liability. I accept full responsibility for any guests I bring to the facility, including minors and non-members. I agree to ensure that all guests comply with facility rules, safety guidelines, and staff instructions. I understand that I am personally liable for any injury, property damage, or equipment damage caused by my guests, and I agree to indemnify and hold harmless Fairways Golf Texas LLC for any claims arising from the actions or negligence of my guests.
5. Unsupervised Facility. I understand that Fairways Golf Texas LLC operates as a self-service, technology-assisted facility and that staff may not be present on-site at all times. I acknowledge that during unstaffed or reduced-staff hours I am responsible for my own safety and the safety of my guests, for the proper use and care of all equipment, and for securing the facility upon departure if I am the last patron. I agree that the absence of on-site staff does not diminish my obligations under this waiver.
6. Bring Your Own Beverage (BYOB). I understand that Fairways Golf Texas LLC permits patrons to bring their own alcoholic and non-alcoholic beverages onto the premises. I acknowledge that Fairways Golf Texas LLC does not sell, serve, or provide alcoholic beverages and assumes no responsibility for the consumption of alcohol by me or my guests. I agree to consume alcohol responsibly, to not provide alcohol to anyone under the legal drinking age of 21, and to not operate a vehicle while impaired. I accept full liability for any injury, damage, or incident that results from alcohol consumption by myself or my guests while on the premises.
7. Personal Property. I understand that Fairways Golf Texas LLC is not responsible for lost, stolen, or damaged personal property.
8. Photo/Video Consent. I grant permission to Fairways Golf Texas LLC to use photographs or video taken during my visit for promotional purposes, unless I opt out in writing.
9. Medical Conditions. I confirm that I am physically able to participate in golf simulator activities and have no medical conditions that would prevent safe participation, or I have consulted my physician and received clearance.
10. Minors. If signing on behalf of a minor, I confirm I am the parent or legal guardian and accept these terms on their behalf. I understand that minors under the age of 16 must be accompanied and actively supervised by an adult member at all times while on the premises. I accept full responsibility for the behavior, safety, and any damage caused by any minor in my care.

This waiver is binding and shall be construed under the laws of the State of Texas. I have read, understood, and voluntarily agree to the terms above.
